Hat Rental Terms & Conditions

SECTION 1—PARTIES 

Hat Rental Agreements ("Agreement") will be made between TROVADOUR LLC ("Company") and the customer renting the hat ("Renter"). Renter must be 18 years or older to rent a hat.

SECTION 2—RENTAL PERIOD

The Agreement shall begin on an agreed upon date between the Company and Renter and end on a specified date ("Rental Period"). Renter must return the Hat on or before the end of the Rental Period.

SECTION 3—RENTAL FEE

Renter agrees to pay Company a rental fee of $100 per day for the duration of the Rental Period. This fee is due in full before taking possession of the Hat. Rental Period cost will not exceed the value of the hat. A security deposit equal to the value of the hat will also be due open pickup.

SECTION 4—PICK UP & RETURN

All hat rentals must be picked up and returned in person at the TROVADOR Customs showroom located at 1204 E Cesar Chavez St B, Austin, TX 78702.

SECTION 5—SECURITY DEPOSIT

Renter must pay a security deposit equal to the value of the hat to Company before taking possession of the Hat. This deposit will be refunded upon timely return of the Hat in good condition within the rental period, reasonable wear and tear excepted. If the hat is not returned within the agreed timeframe, a late fee of $100 per day will be charged to the Renter. If the Hat is not returned within 18 days after the stated Rental Period end date, Renter forfeits their security deposit and will not be permitted to return the Hat. If the Hat is lost due to theft, mysterious disappearance, fire, or any other disatser, Renter will forfeit the entire value of the security deposit.

SECTION 6—CONDITION OF HAT

Renter acknowledges receiving the Hat from Company in good condition. Renter agrees to return the Hat to Company in the same condition, minus normal wear and tear. Normal wear and tear is defined as minor scuffing, minor discoloration, or minor marks that do not impact the structural integrity or functionality of the Hat. This excludes tears, rips, missing or damaged design components (beads, leathers, stones, feathers, etc.), water damage, disfigured shape, or any damage that inhibits the functionality or aesthetics of the Hat. The Hat must be returned in clean condition without stains, damage, or excessive dirt.

SECTION 7—LOST OR DAMAGED HAT

If the Hat is lost or damaged during the Rental Period, Renter is responsible for the reasonable costs of repair or replacement value up to $1800 to Company. If the Hat is damaged beyond repair, Renter is responsible for paying the entire cost of the hat, up to $1800.

SECTION 8—CLEANING FEE

Renter agrees to pay Company a cleaning fee if the Hat is returned dirty beyond expected normal wear and tear outlined in section 6.

SECTION 9—USE OF HAT

Renter agrees to use the Hat rented from Company in a safe, lawful, and responsible manner. Renter shall not alter or modify the Hat without Company’s written consent.

SECTION 10—INDEMNIFICATION

Renter agrees to indemnify, defend, and hold harmless Company from any costs, damages, liabilities, or losses arising from Renter's use, transportation, or possession of the Hat.

SECTION 11—GOVERNING LAWS 

This Agreement shall be governed under the laws of Texas.

SECTION 12—ENTIRE AGREEMENT

Renter acknowledges reading and understanding this Agreement and agrees to be bound by its terms and conditions. This Agreement represents the complete agreement and understanding between the parties. Any modifications to this Agreement must be made in writing and signed by both parties.

EXCEPT FOR LIMITED CIRCUMSTANCES DESCRIBED IN SECTION 7 & 8 OF THE ARBITRATION AGREEMENT ABOVE, YOU AGREE THAT DISPUTES BETWEEN YOU AND US WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION, OR TO A TRIAL BY JURY.
